Virtual Items & In-App Purchases

Our Services may include virtual currency, virtual goods, digital content, or other in-game items ("Virtual Items"). Virtual Items have no real-world monetary value and cannot be exchanged for real money, goods, services, or any other value outside the game environment. All purchases of Virtual Items are final and non-refundable, except where expressly required by applicable law or platform rules (e.g., Apple App Store, Google Play Store). We reserve the right to manage, modify, or delete Virtual Items at our sole discretion, with or without notice.

User Conduct & Prohibited Activities

You agree not to engage in any of the following prohibited activities while using the Services:

• Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Services.
• Exploit bugs, glitches, or errors in the Services for personal gain or to the detriment of other users.
• Harass, threaten, bully, abuse, or cause harm to other players, including hate speech or discriminatory behavior.
• Engage in fraudulent transactions, account trading, selling, or unauthorized access to another user's account.
• Reverse engineer, decompile, or disassemble any part of the Services except where permitted by applicable law.

Violation of these rules may result in immediate suspension, permanent account termination, and forfeiture of any Virtual Items or progress.

Account & Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach. We will not be liable for any loss or damage arising from your failure to protect your account information. Account sharing, selling, or transferring is strictly prohibited unless explicitly authorized by us.

Intellectual Property Rights

All rights, title, and interest in and to the Services (including but not limited to software, artwork, graphics, music, sound effects, characters, storylines, trademarks, and logos) are owned by PebblePlay Inc or its licensors. These Terms do not grant you any right, title, or interest in our intellectual property. You may not copy, modify, distribute, or create derivative works based on our Services without our prior written consent.

Updates & Changes to the Terms

We may update or modify the Services from time to time, including adding or removing features, adjusting pricing, or changing functionality. We reserve the right to revise these Terms at any time. If we make material changes, we will provide notice within the Services or via email. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

Termination & Suspension

We may, without prior notice, suspend or terminate your access to the Services if you breach these Terms or engage in illegal or fraudulent activities. Upon termination, your right to use the Services will immediately cease, and any Virtual Items or progress may be forfeited without refund. You may also terminate these Terms by ceasing all use of the Services and deleting any associated applications.

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PebblePlay Inc AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming. You agree to waive any objection based on improper venue or forum non conveniens.
